1. Introduction & Acceptance
Welcome to Digital Ocean (“we”, “our”, “us”), trading as digitalocean.world. By engaging our services — including website design, hosting, logo design, and digital content creation — you (“the Client”) agree to the following Terms of Service (“Terms”).
If you do not agree, please discontinue use of our services.
2. Services Provided
We provide creative and technical services including:
- Website design and hosting
- Logo design and brand creation
- Social media content and digital marketing assets
- Ongoing site maintenance and updates
3. Payments & Pricing
- All pricing is quoted in Australian Dollars (AUD) and includes GST unless otherwise stated.
- Deposits are required prior to work commencing; final payment is due upon completion unless agreed otherwise.
- Payments are securely processed via Stripe or other approved methods.
- Once design or development work has commenced, payments are non-refundable except as required under Australian Consumer Law.
4. Revisions & Project Changes
- Each project includes a specific number of revisions, as outlined in your proposal.
- After final approval, further changes may incur additional charges.
- Final logo and design files are supplied in non-editable formats (JPG, PNG, or PDF).
5. Ownership & File Rights
- Digital Ocean retains ownership of all website files and assets hosted on our servers unless otherwise agreed.
- Editable or transferable files can be provided upon request at an additional release fee.
- All graphic and logo designs become the client’s property once full payment has been received.
6. Hosting & Maintenance
- Hosting plans start from $10/month and include managed updates and backups.
- We are not liable for downtime caused by third-party services or maintenance events.
- We ensure your site remains secure with SSL and regular updates, but no system is entirely risk-free.
7. Content Responsibility
- Clients must provide accurate and lawful content for use on their website or marketing materials.
- Digital Ocean is not responsible for errors, copyright issues, or claims relating to materials supplied by clients.
8. Cancellation & Termination
- Projects may be cancelled in writing; completed work remains billable.
- Hosting or service subscriptions may be cancelled at any time, with access continuing until the paid term ends.
- We may suspend or terminate services for misuse, non-payment, or policy violations.
9. Limitation of Liability
All services are provided “as is” without warranties of any kind. We are not liable for indirect or consequential damages such as data loss or loss of income. Our total liability is limited to the total amount paid for services within the 12 months prior to any claim.
Nothing in these Terms removes your rights under the Australian Consumer Law (ACL).
10. Privacy
We handle personal information in accordance with our Privacy Policy. Client data is kept secure and confidential at all times.
11. Changes to Terms
We may update these Terms from time to time. Continued use of our services after updates means you accept the revised Terms. Updates will be reflected by the date shown above.
